Abstract AUTHORITY FOUND -;UNJUSTIFIED DISMISSAL: Applicant not given option during final meeting to consider resignation with exit package or 12 month fixed term agreement with access to incentive trip. Final meeting exit interview meaning applicant's behaviour and remarks during earlier engagements sufficient for respondent to believe applicant resigning. Applicant resigned. Applicant denied writing letter denying resignation. Respondent declined subsequent offer from applicant to withdraw termination of employment but applicant's resignation sufficiently explicit and offer made five weeks after termination of employment could not undo earlier resignation. Respondent acted fairly and reasonably despite applicant not complying with employment agreement by resigning in writing. No dismissal.
