Abstract AUTHORITY FOUND –;UNJUSTIFIED DISMISSAL: Applicant became angry in performance review meeting and walked out. Likely that applicant misunderstood respondent’s intentions and assumed about to be dismissed. Reasonable to hold performance review in circumstances. Respondent’s manager tried to contact applicant after applicant left and discuss status of employment. Applicant asserted dismissal very early on. Respondent did not let applicant think he had been dismissed. Applicant resigned of own volition. No dismissal.;PENALTY: Respondent failed to provide written employment agreement in accordance with s 65 Employment Relations Act 2000. Need for deterrence. $1,000 penalty appropriate.;COUNTERCLAIM – RECOVERY OF MONIES: More than likely applicant took sneakers without permission or paying for them. Applicant to pay respondent $249 recovery of monies.
