| Summary | PARENTAL LEAVE - Applicant sought relief under s68(5) Parental Leave and Employment Protection Act 1987 to forgive non-compliance with formal requirements of the Act – Applicant had applied for paid parental leave but application not received by IRD until after he returned to work – Applicant applied for and was granted paid parental leave for eight weeks to enable him to travel to Thailand with his wife to adopt an abandoned four year old girl – Applicant was unsure as to whether he would receive full pay from his employer and so sought clarification before posting form to IRD – Nature of irregularity minor (default of one day) – The time of the year (being Christmas) meant there was genuine difficulty in getting matter dealt with by human resources because relevant people on annual leave – Application granted |
